Enrolment Terms & Conditions
Please read all sections before enrolling. Completing enrolment confirms you have read and accepted each policy below.
Refund Policy
This Refund Policy outlines the requirements for requesting and processing refunds across all Scholarly courses and programs. Scholarly will consider all refund requests on a case-by-case basis in accordance with the terms set out below. These terms may be updated from time to time at Scholarly's absolute discretion, subject always to the Australian Consumer Law.
Fees are non-refundable for change of mind once a course has commenced, except where a remedy is required under the Australian Consumer Law. Scholarly does not offer trial periods or change-of-mind refunds.
Returns, refunds or exchanges are generally not provided for change-of-mind or personal reasons. Any decision to provide a return, refund or exchange as a gesture of goodwill is solely at Scholarly's discretion. All fees paid are considered non-refundable upon commencement of the course or program, except where a remedy is required under the Australian Consumer Law.
Scholarly does not offer a trial period for any course or program. No refund, credit, or replacement is available simply because a student attended and then decided not to continue, unless a remedy is required under the Australian Consumer Law.
No refund, credit, or replacement is available for multi-term enrolments for change-of-mind or personal reasons. By enrolling across multiple terms, you accept full liability for all fees associated with those terms, except to the extent that a remedy is required under the Australian Consumer Law.
No credits, refunds, or makeup classes are provided for missed sessions during the term (including absence due to illness, school events, travel, or other commitments), unless required by law. Dis-enrolment mid-term due to change of circumstances is not permitted. The minimum enrolment period is one complete term and fees are charged accordingly.
Once the current term is over, unused classes or class time do not carry over to the next term, unless Scholarly is required to provide a remedy under the Australian Consumer Law.
Where a student's enrolment is cancelled due to behavioural issues or a breach of the Student Policy, no refund is provided for change-of-mind or misconduct. This does not limit any rights you may have under the Australian Consumer Law if Scholarly has not met its obligations in providing the service.
For any discretionary refund that Scholarly may consider, refund requests must be submitted in writing by email within one week of the date of purchase. Requests should include your name and contact details, a full description of the transaction, detailed reasons for the request, and copies of all relevant documents. Requests received after this timeframe will not be considered as discretionary refunds. This timeframe does not limit or reduce any rights you may have under the Australian Consumer Law.
For any discretionary refund that Scholarly approves, an administration and banking surcharge of at least 20% will be deducted before any further calculation is applied.
Scholarly may, in rare and exceptional circumstances, consider a discretionary refund before a course or program has commenced. Where Scholarly chooses to approve a discretionary refund, an administration and banking surcharge of at least 20% may apply. This does not limit any rights or remedies you may have under the Australian Consumer Law.
For goods supplied by Scholarly, exceptional circumstances include situations where an item is seriously defective and within Scholarly's control. Evidence of the defect must be provided. Scholarly may offer a repair, replacement, refund, or alternative remedy as appropriate, in accordance with the Australian Consumer Law.
- Refunds for individual components of a package will not be considered for change-of-mind or personal reasons.
- No discretionary refund is available for change-of-mind once a course has started.
- No discretionary refunds for missed classes, absences, or non-attendance for any reason.
- No discretionary refunds for multi-term enrolments.
- No discretionary refunds where enrolment is cancelled due to behavioural issues.
- No discretionary refunds based on exam outcomes, marks, or school offers not being achieved.
- Events outside Scholarly's control (including illness, school activities, travel, or family commitments) do not constitute exceptional circumstances for change-of-mind refunds.
Nothing in this policy excludes, restricts or modifies any rights you may have under the Australian Consumer Law. Where Scholarly is required to provide a remedy under that law, Scholarly will do so in accordance with the nature of the problem (for example, repair, replacement, repeat service or refund for the unused portion, as applicable).
Credits Policy
This Credits Policy outlines the circumstances under which Scholarly may offer a credit in lieu of a refund. Scholarly will consider all credit requests on a case-by-case basis. These terms may be updated from time to time at Scholarly's absolute discretion, subject always to the Australian Consumer Law.
Credits are not refunds. Scholarly may, in limited cases and at its sole discretion, offer a credit towards a future course. Credits are not automatically available and do not limit any rights to a refund or other remedy that you may have under the Australian Consumer Law.
Approved credits do not expire and remain available for use towards Scholarly enrolments, unless otherwise required by law.
Credits cannot be converted to cash or redeemed for a monetary refund, except where Scholarly is required to provide a refund under the Australian Consumer Law. Credits are not transferable to another person and cannot be used in conjunction with other offers or discounts unless stated otherwise.
A credit offered in one situation does not create any obligation to offer credits in any other situation, past or future. Decisions on credits are solely at Scholarly's discretion and are made in addition to, and not in place of, any rights or remedies you may have under the Australian Consumer Law.
Nothing in this policy excludes, restricts or modifies any rights you may have under the Australian Consumer Law.
Terms & Conditions
By enrolling in any Scholarly course or program, you confirm that you have read, understood, and agree to be bound by these terms. "Scholarly" refers to Scholarly Training, "you" refers to the parent or guardian, and "student" refers to the enrolled child.
Scholarly courses are available to students preparing for OC, Selective, Private School Scholarships or High School Entrance Exams. Enrolments are for bona fide applicants only. Scholarly reserves the right to decline any application where enrolment details are incomplete, inaccurate, misleading, or otherwise inconsistent with the intended purpose of the course. Where an enrolment is cancelled because it is determined to be invalid or unauthorised, any refund, credit, or other remedy will be determined in accordance with the Refund Policy and any rights available under the Australian Consumer Law. The minimum enrolment period is one complete term (10 weeks). Unless required by law or expressly approved by Scholarly, there is no carryover between terms.
Course fees must be paid in full before the commencement of the term or program. Scholarly is under no obligation to reserve a place until full payment is confirmed. A student may be suspended from classes or excluded from platform access if fees remain unpaid. Fees may increase from term to term. Promotional offers carry their own terms and cannot be combined with other offers.
Students are expected to attend all scheduled classes. Missed sessions do not ordinarily attract a credit, refund, or carryover where absence is due to personal circumstances, illness, travel, school events, or other commitments, unless required by law. Leave requests must be submitted to the relevant course instructor at least two weeks in advance. Where a student discontinues mid-term for change-of-mind or personal reasons, no refund will ordinarily be provided unless required under the Australian Consumer Law.
All course content, including classes, homework, and trial tests, is accessible for two weeks after the program concludes. Scholarly is under no obligation to provide access beyond this period. Scholarly reserves the right to cancel or reschedule classes and will make appropriate arrangements where this occurs.
All Scholarly materials are the intellectual property of Scholarly and are provided for the personal educational use of the enrolled student only. Downloading, saving, recording, screenshotting, reproducing, or distributing materials in any form is strictly prohibited. Violations by current students may result in disciplinary action, including suspension or expulsion, and may affect eligibility for any discretionary refund or credit, subject always to the Australian Consumer Law. Violations by former students or unauthorised users may result in civil or criminal proceedings where appropriate.
Personal information collected at enrolment is kept confidential and used only for account creation and program communication. Scholarly will not sell, rent, or trade student or parent information. Information may be shared within Scholarly for administrative purposes. Disclosure to external parties occurs only where required or authorised by law, or where written consent has been provided.
Where Scholarly platforms allow content uploads, you grant Scholarly a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display that content. You must not upload content that is unlawful, defamatory, abusive, discriminatory, or that infringes intellectual property rights. Scholarly may remove non-compliant content without liability.
You are responsible for maintaining the confidentiality of your login credentials and must notify Scholarly immediately of any unauthorised access. Scholarly may suspend or terminate accounts that are inactive for extended periods or where a breach has occurred.
To the fullest extent permitted by law, Scholarly excludes liability for indirect, incidental, special, or consequential loss arising from participation in its services. Any liability of Scholarly in connection with the supply of services is limited to the remedies available under the Australian Consumer Law and any other rights that cannot lawfully be excluded. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, statutory right, or remedy that cannot lawfully be excluded. By enrolling, you agree to indemnify Scholarly, its staff, affiliates, and partners for claims, losses, or legal costs arising from your unlawful conduct, misuse of Scholarly services, or breach of these terms, to the extent permitted by law.
Scholarly reserves the right to update these terms at any time. Continued use of Scholarly's services following any update constitutes acceptance of the revised terms.
Nothing in these terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law or any other applicable legislation.
Student Policy
Scholarly is built on respect, effort, and integrity. These standards apply to all students and parents across every platform and interaction.
Students are expected to attend all scheduled classes on time and to submit homework by the due date. Work submitted late or in a non-compliant format may not be treated as completed. Parents and guardians are responsible for supporting consistent attendance and timely submission at home.
All students must treat tutors, staff, and fellow students with respect at all times across live classes, messaging platforms, and any Scholarly-affiliated environment. Scholarly operates a zero-tolerance policy for discrimination, harassment, bullying, and disruptive conduct. Persistent misconduct may result in suspension or permanent exclusion and may affect eligibility for any discretionary refund or credit, subject always to the Australian Consumer Law. As the enrolling parent or guardian, you are responsible for your child's conduct on all Scholarly platforms.
All submitted work must be the original work of the student. Plagiarism, copying, and the use of unauthorised aids are strictly prohibited. Breaches may result in:
- A formal warning
- Grade penalties on the affected work
- Temporary suspension
- Permanent expulsion in cases of repeated or serious violations
Login credentials are personal and must not be shared. Students must not use Scholarly platforms to distribute unlawful, offensive, or irrelevant content. Students and guardians are responsible for maintaining secure devices and safeguarding personal data. Scholarly may remove content and revoke access where these standards are not met.
Course materials are provided for the personal educational use of enrolled students only. Materials must not be downloaded, shared, or reproduced in any form. Access is available for two weeks after the program concludes. Breaches may result in disciplinary action, including suspension or expulsion, and may affect eligibility for any discretionary refund or credit, subject always to the Australian Consumer Law. Scholarly may also take legal action where appropriate.
By enrolling, you confirm that all information provided to Scholarly is accurate and complete to the best of your knowledge. Providing false, misleading, or incomplete information may result in enrolment being refused or cancelled. Where this occurs, any refund, credit, or other remedy will be determined in accordance with the Refund Policy and any rights available under the Australian Consumer Law. By enrolling, you also confirm that you have read and accepted all policies on this page.
